Halle Berry's ex Gabriel Aubry is expected to use Kate Middleton's photo scandal as ammunition in his plight to stop the actress moving to France with their daughter Nahla.
Berry is currently trying to persuade lawyers to let her move the toddler across the Atlantic, away from her father, on the grounds that there will be far less intrusion from paparazzi.
However, the French edition of Closer's decision to print topless photographs of the Duchess of Cambridge, taken while she was holidaying in private in the country, may provide a setback, according to TMZ.

The site reports that Aubry's biggest arguement had been the death of Princess Diana after a shocking paparazzi chase, but the fact it was 15 years ago was not thought to make it a particularly effective reason.
However, it is claimed that it is "almost certain" that his lawyers will bring up Kate's controversy when the trial resumes.
That said, it is still thought that Berry will eventually get her way, seeing as she has had primary physical custody of Nahla since she was born.
